The applicant drawing up the Will is required to come to the Embassy in person and would be interviewed by the Consular Officer before attestation of the Will. There is no relaxation to this rule.

In case of applicant of Indian holding other nationality, the Embassy will attest Will only after it has been apostilled by the State Department or the concerned Embassy of the applicant in USA. Document can be Apostilled at the Office of the Secretary of State where the applicant resides.

Will of a dead person will not be attested at the Embassy.

Will of a mentally incapacitated person will not be accepted. Such cases will be entertained only if applicant has notarized judicial orders of guardianship of the person who is the main executor of the Will.

How to Apply:

1.

Download the Miscellaneous Application form and fill it up carefully. Each applicant is required to fill up separate Miscellaneous Application form and affix his/her photograph on the same.

2.

TheWill document to be attested should be presented in original and submitted with following: (i) applicant will sign on the WILL as per signature on his/her recent valid passport; (ii) a recent passport size color photo of the applicant affixed on the WILL; (iii) full name, contact address and signatures of two local witnesses (other than family members). If witnesses are not coming in person to Embassy, their signatures should be DULY NOTARISED.

Applicant’s current valid passport in original and its photocopy. Those having Indian passport may provide original and photocopies of the first five pages and last two pages of the passport. Original and photocopy of the document showing valid US visa status.

4.

Original and photocopy of any of the following documents as proof of residence: US Driving License, Utility Bill, Lease Agreement, State Identity Card, Mortgage Deed, or State Identification Card.

5.

Carry all original supporting documents for presentation to the Consular Officer. Photocopies of these documents may be attached with the application.  Ensure that photocopies of these documents are legible.

6.

Fee:  A fee of US$ 20 (twenty) per attestation and of US$2 (two) towards Indian Community Welfare Fund (ICWF).  The fees may be paid in cash or as two separate money order/cashiers’ cheque, drawn separately towards fee and ICWF, in favour of Embassy of India, Washington DC.

7.

Processing Time: Same day, however, if unforeseen technical reasons occur, services can be delayed till those problems are resolved.
